This is a Notice of Violation ("Notice") issued pursuant to Section 1.89 of the Commission’s Rules,1 to Charter Communications, operator of a cable system in Irwindale, California. 2. On October 8, 2009, an agent of the Enforcement Bureau’s Los Angeles Office inspected the Charter Communications cable system located at 4781 Irwindale Avenue, and observed the following violation: a. 47 C.F.R. § 76.1700(a): “The operator of every cable television system having 5000 or more subscribers shall maintain for public inspection a file containing a copy of all records required to be kept by § 76.1701 (political file). . . . (b) The public inspection file shall be maintained at the office which the system operator maintains for the ordinary collection of subscriber charges, resolution of subscriber complaints, and other business or at any accessible place in the community served by the system unit(s) (such as a public registry for documents or an attorney’s office). The public inspection file shall be available for the public inspection at any time during regular business hours.” At the time of the inspection, the political file was being maintained at a different address. 3. Pursuant to Section 403 of the Communications Act of 1934, as amended,2 and Section 1.89 of the Commission's Rules, Charter Communications, must submit a written statement concerning this matter within 20 days of release of this Notice. The response must fully explain each violation, must 1 47 C.F.R. § 1.89. 2 47 U.S.C. § 403. Federal Communications Commission 2 contain a statement of the specific action(s) taken to correct each violation and preclude recurrence, and should include a time line for completion of pending corrective action(s). The response must be complete in itself and signed by a principal or officer of the Charter Communications.
