Box 971030 Waiphau, Hawaii 96797-1030 February 17, 2010 Adam Townley-Wren Honolulu, HI 96815 NOTICE OF UNLICENSED OPERATION Case Number: EB-10-HL-0029 Document Number: W201032860001 On February 5, 2010, in response to a complaint, an agent from the Enforcement Bureau’s Honolulu Office, using direction finding methods, located an active Emergency Locator Transmitter (ELT) in a duffle bag in the back seat of a private vehicle, parked in the Island Air parking lot at 99 Kapalulu Place in Honolulu, Hawaii. The ELT had been activated by Adam Townley-Wren, and was inadvertently allowed to transmit continuously on 121.5 MHz and 243 MHz causing interference to the Search and Rescue Satellite (SARSAT). There was no indication of any threat to safety of life and property. ELTs are normally associated with an aircraft. An aircraft station is licensed by rule and normally does not need an individual license issued by the FCC. However, as there was no associated aircraft and Commission records show that no license was issued for operation of this ELT, the ELT operation was in violation of 47 U.S.C. § 301. You are hereby warned that operation of radio transmitting equipment without a valid radio station authorization constitutes a violation of the Federal laws cited above and could subject the operator of this illegal operation to severe penalties, including, but not limited to, substantial monetary forfeitures, in rem arrest action against the offending radio equipment, and criminal sanctions including imprisonment. (See 47 U.S.C. §§ 401, 501, 503 and 510.) UNAUTHORIZED OPERATION OF THIS RADIO TRANSMITTING DEVICE MUST CEASE IMMEDIATELY.
