This is a Notice of Violation (“Notice”) issued pursuant to Section 1.89 of the Commission’s Rules1 to Chris Hutton, the licensee of a Citizens Band Radio Service Station and owner of Hutton’s CB Shop, LLC. in Brookville, Pennsylvania. 2. On December 18, 2009, an agent of the Commission’s Philadelphia Office inspected Chris Hutton’s Citizens Band radio station located inside Hutton’s CB Shop in Brookville, Pennsylvania and observed the following violation: 47 C.F.R. § 95.411 (CB Rule 11): "May I use power amplifiers? (a) You may not attach the following items (power amplifiers) to your certificated CB transmitter in any way: (1) External radio frequency (RF) power amplifiers (sometimes called linears or linear amplifiers); …" At the time of the inspection, the agent determined that Chris Hutton’s CB station had a Dave Made M80 linear amplifier connected in- line with his certificated CB transmitter. 3. Pursuant to Section 308(b) of the Communications Act of 1934, as amended,2 and Section 1.89 of the Commission's Rules, Chris Hutton must submit a written statement concerning this matter within twenty (20) days of release of this Notice. The response must fully explain each violation, must contain a statement of the specific action(s) taken to correct each violation and preclude recurrence, and should include a time line for completion of pending corrective action(s). The response must be complete in itself and signed by Chris Hutton.
