This is a Notice of Violation (“Notice”) issued pursuant to Section 1.89 of the Commission’s Rules1 to Darin Groeneweg, licensee of a Citizens Band (“CB”) Radio Service station in Byron Center, MI. 2. On January 25, 2010, an agent of the Commission’s Detroit Office inspected your CB radio station located at 131 CB Radio Shop, Inc., 720 Clyde Ct. SW, Byron Center, Michigan 49315 and found the following violation: 47 C.F.R. § 95.409: “(CB Rule 9) What equipment may I use at my CB station? (a) You must use an FCC certificated CB transmitter at your CB station…” During the inspection of your CB station, the agent observed two non-certified CB transceivers - a Connex 4600 in your trailer and a Connex 33T in your vehicle. 3. Pursuant to Section 308(b) of the Communications Act of 1934, as amended,2 and Section 1.89 of the Commission's Rules, Darin Groeneweg, must submit a written statement concerning this matter within twenty (20) days of release of this Notice. The response must fully explain each violation, must contain a statement of the specific action taken to correct each violation and preclude recurrence, and should include a time line for completion of pending corrective action. The response must be complete in itself and signed by you.
