CLYBURN Re: Amendment of Part 27 of the Commission’s Rules to Govern the Operation of Wireless Communications Services in the 2.3 GHz Band, WT Docket No. 07-293; Establishment of Rules and Policies for the Digital Audio Satellite Service in the 2310-2360 MHz Frequency Band, IB Docket No. 95-91, GEN Docket No. 90-357 This Commission is committed to ensuring that this Nation is making the most efficient and effective use of its spectrum. No longer can we allow spectrum that can be used for mobile broadband to sit unused. In the Report and Order before us, we demonstrate exactly how serious we are about this endeavor. I understand that the technical amendments requested by WCS licensees were met with vigorous opposition from both satellite radio service licensees and members of the aviation industry. I am pleased to say that our talented Commission staff was able to address the technical challenges presented in a manner that appropriately accounts for the interests of all stakeholders. The technical rules, performance requirements, and coordination procedures that the Order adopts will expand the availability of satellite radio services to previously unserved areas and protect the communications services that the aviation industry needs to engage in effective aircraft flight tests. I applaud the efforts of the staff of the International Bureau, Office of Engineering and Technology, and the Wireless Telecommunications Bureau for approaching these tough issues with an open mind and working through each one to arrive at a conclusion that best serves the American public.
