This is a Notice of Violation ("Notice") issued pursuant to Section 1.89 of the Commission’s Rules,1 to Silver State Broadcasting LLC, licensee of radio station WLI700 in Las Vegas, Nevada. 2. On May 13 and May 14, 2010, an agent of the Enforcement Bureau’s Los Angeles Office located and conducted monitoring of station WLI700 located at 1455 E. Tropicana Ave., Las Vegas, Nevada. During the monitoring on May 13, along with additional monitoring and an inspection, conducted on May 14, 2010, the agent observed the following violation: a. 47 C.F.R. § 1.903(a): “Stations in the Wireless Radio Services must be used and operated only in accordance with the rules applicable to their particular service as set forth in this title and with a valid authorization granted by the Commission…” The license for station WLI700 specifies the coordinates 36° 06’ 01.8” north latitude and 115º 30' 5" west longitude with a street address of 1455 E. Tropicana Ave., Las Vegas, Nevada, with an antenna main beam azimuth of 180 degrees. At the time of the monitoring and inspection, the agent observed that Silver State Broadcasting LLC was operating station WLI700 at the coordinates of 36° 06’ 01” north latitude 115° 07’ 56” west longitude, with a street address of 1455 E. Tropicana Ave., Las Vegas, Nevada, and with an antenna main beam azimuth of 246 degrees. Although the station was operating at the street address listed on the WLI700 1 47 C.F.R. § 1.89. Federal Communications Commission 2 license, it was not operating at the coordinates listed in the license, nor was its antenna positioned consistent with its license. 3. Pursuant to Section 308(b) of the Communications Act of 1934, as amended,2 and Section 1.89 of the Commission's Rules, Silver State Broadcasting, LLC, must submit a written statement concerning this matter within 20 days of release of this Notice. The response must fully explain each violation, must contain a statement of the specific action(s) taken to correct each violation and preclude recurrence, and should include a time line for completion of pending corrective action(s). The response must be complete in itself and signed by a principal or officer of the Silver State Broadcasting, LLC.
