This is a Notice of Violation ("Notice") issued pursuant to Section 1.89 of the Commission’s Rules,1 to the Atlantic City Medical Center (“ACMC”), the licensee of radio station KEM680 in Pomona, New Jersey. 2. On November 17, 2010, agents of the Enforcement Bureau’s Philadelphia Office monitored radio station KEM680 located in Pomona, New Jersey and observed the following violation: 47 C.F.R. § 1.903(a): “Stations in the Wireless Radio Service must be used and operated only in accordance with the rules applicable to their particular service as set forth in this title and with a valid authorization granted by the Commission under the provisions of this part.” The license for Station KEM680 authorizes ACMC to operate a paging system on 163.250 MHz from Jim Lees Road, Pomona, New Jersey at the coordinates 39o 26’ 34.4” North Longitude and 074o 35’ 05.6” West Longitude. At the time of the inspection, ACMC was operating the station from the correct address, but a coordinate discrepancy existed on the license. Specifically, ACMC was operating the paging system from the coordinates 39o 28’ 47.0” North Longitude and 074o 32’ 26.5” West Longitude. 3. Pursuant to Section 403 of the Communications Act of 1934, as amended,2 and Section 1.89 of the Commission's Rules, the Atlantic City Medical Center must submit a written statement concerning this matter within 20 days of release of this Notice. The response must fully explain each violation, must contain a statement of the specific action(s) taken to correct each violation and preclude recurrence, and should include a time line for completion of pending corrective action(s).
