I appreciate your interest in this matter. The staff has included your letter in the record of this proceeding. As you note, Zoom filed a complaint on November 29,2010, alleging that Comcast Cable Communications, LLC violated FCC regulations implementing Section 629 of the Communications Act, as well as the Commission's Open Internet Principles. Specifically, Zoom has alleged that Comcast subjects cable television modems to a physical and environmental testing regime before the devices may be attached to Comcast's cable systems. Comcast has submitted a response addressing the allegations discussed in the complaint and Zoom has replied to Comcast's response. The Commission staff is reviewing the issues in the Zoom complaint along with the complete record compiled in the proceeding. If it is determined that Comcast has violated the Commission's regulations, please be assured that appropriate action will be taken to ensure the company's full compliance.
