S2828SAT-PPL-20110620-00112 E Petition for Declaratory Ruling to be Added to the Permitted List 06/20/2011 16:23:00:16600Date Filed: New Skies Satellites B.V. New Skies Satellites B.V. has filed a Petition for Declaratory Ruling, pursuant to Section 25.137 of the Commission's rules, seeking U.S. market access for its SES-4 space station at the 22° W.L. orbital position. New Skies states that SES-4 will operate at 22° W.L. pursuant to an authorization from the administration of the Netherlands and will replace the NSS-7 space station that currently operates at this orbital position. Specifically, New Skies requests: (1) the inclusion of SES-4 on the Permitted Space Station List for the provision of Fixed-Satellite Service to, from and within the United States using the 3700-4200 MHz (space-to-Earth), 5925-6425 MHz (Earth-to-Space), 11700-12200 MHz (space-to-Earth), and 14000-14500 MHz (Earth-to-Space) frequency bands; (2) a ruling permitting the use of the 3625-3700 MHz (space-to-Earth), 5850-5925 MHz, 10950-11200 MHz (space-to-Earth), 11450-11700 MHz (space-to-Earth), and 13750-14000 MHz (Earth-to-Space) frequency bands for the provision of international FSS and limited tracking, telemetry and command operations; and (3) authority to provide direct-to-home (DTH) FSS within the United States and between the United States and certain other countries. New Skies states that the frequencies requested for market access by SES-4 are the same as those now being operated on NSS-7, except for the 13750-14000 MHz uplink frequency band, which only exists on SES-4.
