Thank you for your leller concerning the Commission's January 20 I0 Notice ofProposed
Rulemaking (NPRM) implementing the Telephone Consumer Protection Act (TCPA). In
particular, you expressed concern aboulthe definition ofautodialers as applied to predictive
dialers. I appreciate your thoughts on this mallcr and will ensure that your Icttcr is placed in the
record ofthe proceeding.
The Commission has received numerous comments on the predictive dialcr issue, both in
written comments and in meetings covered by our ex parte rules. As in your leller, several
commenting parties have expressed conccrn about the definition ofautodialers provided in the
TCPA and its application to predictive dialers. We give serious considcration to all comments
from mcmbcrs ofthe public; the staff is carefully reviewing these particular filings as the
Commission moves closer to decisions on the issues raised in the January 20 JONPRM.
