This is a Notice of Violation ("Notice") issued pursuant to section 1.89 of the Commission's rules1 to Capstar Radio Operating Company, owner of antenna structures 1031109, 1031110, and 1031111 located in Whitehall, Pennsylvania. 2. On September 14, 2011, an agent of the Commission’s Philadelphia Office inspected antenna structures 1031109, 1031110, and 1031111, which are located at the coordinates 40o 39’ 37.0” North Latitude 075 o 30’ 49.0” West Longitude; 40o 39’ 38” North Latitude 075 o 30’ 52.0” West Longitude; and 40o 39’ 39.9” North Latitude 075 o 30’ 55.2” West Longitude, respectively, and observed the following violation: 47 C.F.R. § 17.4(g): “The Antenna Structure Registration Number must be displayed in a conspicuous place so that it is readily visible near the base of the antenna structure. Materials used to display the Antenna Structure Registration Number must be weather-resistant and of sufficient size to be easily seen at the base of the antenna structure.” At the time of inspection, no Antenna Structure Registration Numbers were visible at the base of antenna structures 1031110 and 1031111. The agent also observed that the sign displaying the Antenna Structure Registration Number for antenna structure 1031109 was not properly labeled.2 1 47 C.F.R. § 1.89. 2 The sign displaying the antenna structure registration number for the antenna structure 1031109 was missing the leading “1” in the number. Pursuant to section 403 of the Communications Act of 1934, as amended,3 and section 1.89 of the Commission's Rules, Capstar Radio Operating Company must submit a written statement concerning this matter within 20 days of release of this Notice. The response must fully explain the violation, must contain a statement of the specific action(s) taken to correct the violation and preclude recurrence, and should include a time line for completion of pending corrective action(s). The response must be complete in itself and signed by a principal or officer of Capstar Radio Operating Company.
