This is a Notice of Violation (Notice) issued pursuant to Section 1.89 of the Commission’s rules1 to Debut Broadcasting Mississippi, Inc., licensee of Station WBBV- FM in Vicksburg, Mississippi. 2. On November 10, 2011, an agent of the Enforcement Bureau’s New Orleans Office inspected Station WBBV-FM, located in Vicksburg, Mississippi, and observed the following violations: a. 47 C.F.R. § 73.258(a): “Each FM broadcast station shall be equipped with indicating instruments which conform with the specifications described in § 73.1215 for determining power by the indirect method; for indicating the relative amplitude of the transmission line radio frequency current, voltage, or power; and with such other instruments as are necessary for the proper adjustment, operation, and maintenance of the transmitting system.” At the time of inspection, Station WBBV-FM was not equipped with indicating instruments that conform to the specifications described in § 73.1215 for determining power by the indirect method. b. 47 C.F.R. § 73.267(a): “The operating power of each FM station is to be determined by either the direct or indirect method.” At the time of inspection, Station WBBV-FM did not have a method in place to determine operating power. 147 C.F.R. § 1.89. Pursuant to Section 308(b) of the Communications Act of 1934, as amended,2 and Section 1.89 of the Commission’s rules, Debut Broadcasting Mississippi, Inc., must submit a written statement concerning this matter within twenty (20) days of release of this Notice. The response must fully explain each violation, must contain a statement of the specific action(s) taken to correct each violation and preclude recurrence, and should include a time line for completion of pending corrective action(s). The response must be complete in itself and signed by a principal or officer of Debut Broadcasting Mississippi, Inc.
