ISP-PDR-20120131-00001 E GovNET Licenses LLC (GovNet Licenses or "Petitioner") requests a declaratory ruling, pursuant to section 310(b)(4) of the Communications Act of 1934, as amended (the "Act"), that the public interest would be served by authorizing 100 percent foreign ownership of Petitioner's controlling U.S. parent company, GovNET, Inc. (GovNET), by Patrick H. Barringer, a Canadian citizen. GovNet Licenses has filed its petition in connection with initial applications for common carrier point-to-point microwave licenses. See ULS File Nos. 0005057077, 0005057078. GovNet Licenses is an Arizona limited liability company with one member, GovNET, an Arizona corporation. GovNET is, in turn, 100 percent owned by Mr. Barringer. Petitioner states that the Commission previously has authorized Mr. Barringer's 100 percent direct and indirect ownership interests in wireless licensee Telink Networks SW, LLC and his 25 percent indirect ownership interest in wireless licensee Teltranet Licenses LLC (citing DA 06-938, 21 FCC Rcd 4382 (IB 2006) and DA 07-2162, 22 FCC Rcd 9319 (IB 2007)). The Petitioner asserts that, pursuant to the rules and policies established by the Commission's Foreign Participation Order, 12 FCC Rcd 23891 (1997), Order on Reconsideration, 15 FCC Rcd 18158 (2000), the proposed indirect foreign ownership of GovNET Licenses in excess of the 25 percent benchmark of section 310(b)(4) of the Act is consistent with the public interest.
