This is a Notice of Violation (Notice) issued pursuant to Section 1.89 of the Commission’s rules1 to Citadel Broadcasting Company (Citadel), registrant of antenna structure numbers 1026574, 1026575, 1026576, 1026577, and 1026578 (Antenna Structures) in Falls, Pennsylvania. 2. On January 12, 2012, agents of the Commission’s Philadelphia Office inspected the Antenna Structures located in Falls, Pennsylvania, and observed the following violations: a. 47 C.F.R. §: 17.51(a): "All red obstruction lighting shall be exhibited from sunset to sunrise unless otherwise specified." At the time of inspection, one of the two steady burning side marker obstruction lights at the one-third level was extinguished on both antenna structure numbers 1026574 and 1026576.2 3. Pursuant to Section 403 of the Communications Act of 1934, as amended,3 and Section 1.89 of the Commission's Rules, Citadel Broadcasting Company must submit a written statement concerning this matter within twenty (20) days of release of this Notice. The response must fully explain each violation, must contain a statement of the specific action(s) taken to correct each violation and preclude recurrence, and should include a time line for completion of pending corrective action(s). The response must be complete in itself and signed by a principal or officer of Citadel Broadcasting Company. All replies and 147 C.F.R. § 1.89. 2 The antenna structure registrations for antenna structures # 1026574 and 1026576 require that the painting and obstruction lighting comply with the FCC paragraphs 1, 3, 12, and 21 which require the antenna structures to be painted and have a top-level flashing red beacon and at least two steady burning side marker obstruction lights at the one-thirds and two-thirds levels. 347 U.S.C. § 308(b).
