This is a Notice of Violation (Notice) issued pursuant to Section 1.89 of the Commission’s Rules,1 to Family Stations, Inc., licensee of radio station KQKD in Redfield, South Dakota. 2. On April 12, 2012, an agent of the Enforcement Bureau’s Denver Office inspected radio station KQKD located at Redfield, South Dakota, and observed the following violations: a. 47 C.F.R. § 73.158(b): “When the description of the monitoring point as shown on the station license is no longer correct due to road or building construction or other changes, the licensee must prepare and file with the FCC, in Washington, DC, a request for a corrected station license showing the new monitoring point description. The request shall include the information specified in paragraphs (a)(3) and (a)(4) of this section, and a copy of the station’s current license. A copy of the description is to be posted with the existing station license.” The 145 degree monitoring point states, “From the intersection of Highway 261 and Highway 212, proceed east on Highway 212 to point designated by sign along fence on north side of highway, 2.77 km from site, max 39.6 mV/m daytime.” Highway 261 and the sign along the north side of Highway 212 no longer exist. The 202.5 degree monitoring point states, “From intersection of Highway 281 and Airport Road, proceed west on Airport Road 0.16 km to point 1 47 C.F.R. § 1.89. Federal Communications Commission 2 designated by sign along fence on north side of road, 3.78 km from site, max 35.2 mV/m daytime.” Airport Road and the sign along the fence no longer exist. 3. Pursuant to Section 308(b) of the Communications Act of 1934, as amended,2 and Section 1.89 of the Commission’s Rules, Family Stations, Inc., must submit a written statement concerning this matter within 20 days of release of this Notice. The response must fully explain each violation, must contain a statement of the specific action(s) taken to correct each violation and preclude recurrence, and should include a time line for completion of pending corrective action(s). The response must be complete in itself and signed by a principal or officer of the Family Stations, Inc.
