tinitcd ~tatcs ~cnatc WASHINGTON, DC 20510 March 29, 2012 The Honorable Julius Genachowski Chairman Federal Communications Commission 445 12th Street, SW Washington, DC 20554 Dear Chairman Genachowski: Over the last year, a struggle has taken place between Lightsquared and the GPS community on the risks of Lightsquared operating in spectnun adjacent to GPS operations, True to your word, you have decided not to allow Lightsquared to operate in that adjacent spectnun after the National Telecommunications and Information Administration determined through an interagency process that doing so would pose insurmountable risks. We understand your decision but urge you to work with the company and other spectnun holders. including federal agencies and the NTIA, to locate and identify alternate spectrum that Lightsquared could use for a nationwide 4G LTE wireless broadband network. Others have rightly pointed out that this situation raises the question of whether the agency should create receiver standards so that license holders operate only in their licensed spectnun and do not foreclose opportunities for others to use this scarce public resource. However, that is a structural issue to consider over the long-term, In the short-term, we urge you to work with industry and the relevant federal agencies to fmd consensus on alternate spectnun for Lightsquared's proposed network. Advancing Lightsquared's network in a consensus manner would increase competition in the wireless broadband market and promote the public interest. Sincerely, .z ;.:,i.~;;l! (J,U :.:: ,l ~~~·t~' 'T·"
