FEDERAL COMMUNICATIONS COMMISSION August 13,2012 JULIUS GENACHOWSKJ CHAIRMAN The Honorable James P. Moran U.S. House of Representatives 2239 Rayburn House Office Building Washington, D.C. 20515 Dear Congressman Moran: Thank you for your letters urging that the Commission consider options that will allow LightSquared to offer its planned wireless broadband service, including authorizing use of alternative spectrum for this service. In one of your letters, you also ask the Commission to conduct a review of spectrum controlled by the Department of Defense (DOD) for potential commercial broadband use. 1 am glad members of my staff were able to meet with your staff to discuss this matter in more detail. Your letters wi II be included in the record of the related proceedings and considered as part of the Commission's review. Commission staff has continued to meet with representatives of LightSquared, and is working with them through the complex issues of this proceeding. Currently, no petition is before the Commission regarding alternative spectrum for LightSquared. Should that change. the Commission will coordinate with NTJA as necessary, and consider any proposals carefully. The Commission also is working closely with NTIA to identify additional Federal spectrum including spectrum used by DOD - for reallocation or for sharing with commercial users. Several bands being examined could be promising resources to address the spectrum crunch and enable the continued acceleration of the mobile broadband economy that is driving economic growth, investment, and valuable new services for consumers and businesses. I appreciate your interest in this matter. Please let me know if] can be of any further assistance. ulius Genachowski 445 12TH STREET S.W.
