tinitcd ~tatcs ~cnatc The Honorable Julius Genachowski Chairman WASHINGTON, DC 20510 September 14, 2012 The Federal Communications Commission 445 121h Street SW Washington, DC 20554 Dear Mr. Chairman: We urge you to have meaningful dialogue with all stakeholders during the development of rules and regulations pertaining to the incentive spectrum auctions and subsequent repacking. As you know, the Middle Class Tax Relief and Job Creation Act of2012 provides for the voluntary relinquishment of broadcast spectrum to make additional spectrum available for mobile broadband use. We strongly support the incentive auctions, which will generate vital revenue for deficit reduction and address the pending "spectrum crunch." Our global leadership in technological innovation depends on increasing available spectrum for wireless broadband communications. However, it is imperative that this effort also protect broadcasters that choose not to participate in such auctions and the American public that relies on over-the-air broadcast services for both entertainment and critical public emergency information. Our constituents deserve a transparent rulemaking process that allows sufficient opportunity to understand and provide input on any proposal affecting their broadcast service. Thank you for your attention to this matter. Richard J. Durbin United States Senator Sincerely, United States Senator 1156
