I appreciate the opportunity to update you concerning the status of this matter. Pursuant to Commission regulations, applications to renew the licenses for radio broadcast stations located in Alabama were due to be filed no later than December 1, 2011, four months prior to their April 1, 2012 expiration date. As you know, Down Home did not file timely renewal applications and, therefore, the broadcast licenses for WCOX and WYVC expired on their own terms. As a result, Down Home's authority to operate the stations terminated, and the call letters were deleted from the Commission's databases. Subsequently, on July 26,2012, Down Home submitted applications to renew the licenses of WCOX and WYVC and, on October 3, 2012, the staff of the Media Bureau's Audio Division dismissed the applications as late-filed petitions for reconsideration. As noted in your correspondence, Down Home very recently filed an Application for Review requesting that the Commission reinstate its renewal applications. Please be assured that the issues discussed in the Application and your letter will be considered carefully, and Down Home will be notified as soon as the Commission reaches a decision.
