This is a Notice of Violation (Notice) issued pursuant to Section 1.89 of the Commission’s rules (Rules)1 to Orion Broadband, operator of a cable system in San Diego, California. Pursuant to Section 1.89(a) of the Rules, issuance of this Notice does not preclude the Enforcement Bureau from further action if warranted, including issuing a Notice of Apparent Liability for Forfeiture for the violations noted herein.2 2. On May 9, 2013, an agent of the Enforcement Bureau’s San Diego Office inspected a cable system located at San Marcos, California, and observed the following violations: a. 47 C.F.R. § 76.1803: “MVPD’s subject to §76.611 must submit the results of ground based measurements derived in accordance with 76.611(a)(1) or airspace measurements derived in accordance with §76.611(a)(2), including a description of the method by which compliance with the basic signal leakage criteria is achieved and the method of calibrating the measurement equipment. This information must be provided to the Commission each calendar year via FCC Form 320.” As of May 9, 2013, there is no record that Orion had filed an FCC Form 320 for its system since 2007.3 b. 47 C.F.R. § 78.29: “Licenses for CARS (Cable Television Relay Service) stations will be issued for a period not to exceed five (5) years.” The agent found that Orion Broadband is transmitting on CARS frequencies at its 1 47 C.F.R. § 1.89. 2 47 C.F.R. § 1.89(a). 3 The San Diego issued a Letter of Inquiry (LOI) to Orion Broadband on August 12, 2012, asking if Orion Broadband had filed an application to renew its CARS license and if Orion Broadband had submitted a Basic Signal Leakage Performance Report, FCC Form 320. The San Diego office received a reply from Orion Broadband on December 12, 2012, that a renewal application had been filed and that Orion Broadband was not aware they were required to submit an FCC Form 320 annually. The FCC has no record of receiving an application to renew this license. 3. Pursuant to Section 403 of the Communications Act of 1934, as amended,4 and Section 1.89 of the Rules, we seek additional information concerning the violations and any remedial actions taken. Therefore, Orion Broadband must submit a written statement concerning this matter within twenty (20) days of release of this Notice. The response (i) must fully explain each violation, including all relevant surrounding facts and circumstances, (ii) must contain a statement of the specific action(s) taken to correct each violation and preclude recurrence, and (iii) must include a time line for completion of any pending corrective action(s). The response must be complete in itself and must not be abbreviated by reference to other communications or answers to other notices.5 4. In accordance with Section 1.16 of the Rules, we direct Orion Broadband to support its response to this Notice with an affidavit or declaration under penalty of perjury, signed and dated by an authorized officer of Orion Broadband with personal knowledge of the representations provided in Orion Broadband’s response, verifying the truth and accuracy of the information therein,6 and confirming that all of the information requested by this Notice which is in the licensee’s possession, custody, control, or knowledge has been produced. To knowingly and willfully make any false statement or conceal any material fact in reply to this Notice is punishable by fine or imprisonment under Title 18 of the U.S. Code.7 5.
