Esperanza is one of eleven applicants that filed for the same channel (92 .9) and location in the Philadelphia area, so it is deemed mutually exclusive (MX) with the other applications. The Commission' s Media Bureau issued a Public Notice on December 16, 2013, identifying the groups of MX LPFM applications, and opened a 60-day window within which the applicants in each group may communicate with each other and seek any of several options available to them to resolve the conflicts through settlements and/or technical amendments. The Bureau is currently identifying the tentative selectee(s) in this group and will provide the list to the Commission for a vote in the coming months. If the MX applicants in their group do not resolve the conflicts, then the Commission awards points to each of the applications in order to determine a tentative selectee(s). The criteria for awarding points are laid out in Section 73.872 ofthe Commission' s Rules (47 CFR § 73 .872), and include the applicant's established community presence, proposed operating hours, and local program origination. The Rules also include tie-breaking criteria that will allow the Commission ultimately to select among the applicants. I appreciate your interest in this matter.
