Teliax Colorado, LLC, Proceeding Number 21-194, Bureau ID No. EB-21-MD-001 Dear Counsel: On June 9, 2021, Teliax filed a motion to extend the date to file its answer in the above-referenced proceeding.1 Teliax states that it is a small company that  recently downsized its staff due to financial issues and has been working on its answer to the complaint while simultaneously continuing to negotiate a settlement with Lumen.2 Teliax requests a new filing date of June 17, 2021. Lumen opposes Teliax s request, arguing that Teliax earlier refused to participate in global settlement discussions to resolve this dispute and one pending in court, and that Teliax created the conditions that required Lumen to file the complaint.3 At the outset, we advised the parties that the schedule was strict and that we were unlikely to grant extensions of time.4 Nevertheless, the Commission has broad discretion to  conduct its [formal complaint] 1 Teliax Colorado, LLC Motion for Extension of Time filed June 9, 2021 (Motion). We also recognize that the six count complaint is complex. Considering these facts, we find it in the public interest to grant Teliax s request to extend the date to file its answer to no later than June 15, 2021. In light of the extension granted for filing the answer to the complaint, we extend the date for filing the reply to June 22, 2021. We also extend the filing date for the joint statement to July 2, 2021. The initial status conference will not take place on July 1, 2021. We will reschedule it as necessary.
