I welcome the opportunity to respond and can assure you that the Federal Communications Commission takes seriously the responsibilities entrusted to it by Congress under the law, including the efforts identified in your letter “to expand connectivity to all Americans, regulate broadcast stations and multichannel video programming distributors (MVPDs) in the media marketplace, limit the transmission of illegal robocalls, preserve the capability for reliable 911 and emergency alerting services, and remove untrusted communications equipment and services from U.S. communications networks.” As requested, I am providing you the following information: 1. A list of all pending or expected Declaratory Rulings on delegated authority by a Bureau or Office of the FCC. Pending Rulemakings. These are listed in section 1.a of the Appendix. This list draws principally from information submitted in connection with the most recent Unified Agenda of Regulatory and Deregulatory Actions (Unified Agenda), pursuant to the Regulatory Flexibility Act, 5 U.S.C. § 602, published in August 2022. See 87 Fed. Reg. 48378 (Aug. 8, 2022), available at https://www.federalregister.gov/documents/2022/08/08/2022-14618/unified-agenda-of- federal-regulatory-and-deregulatory-actions-spring-2022. Because the most recent version of the Unified Agenda included only information as of mid-2022, this list supplements that information with updates for later rulemakings that will be considered in the preparation of the next of these semi-annual filings. The items published or to be published in the Unified Agenda include Commission rulemakings that require notice and comment under the Administrative Procedure Act, 5 U.S.C. § 551 et seq. The Commission is not generally in a position to predict whether the initiation of any new rulemaking is “expected,” since action on a Commission-level activity, such as commencing a rulemaking, requires the affirmative vote of a majority of Commissioners. However, this list includes all pending “notices of inquiry,” which can serve as the precursor to the initiation of a future rulemaking, as well as all future rulemakings that are required by statute. Pending or Expected Declaratory Rulings on Delegated Authority. These are listed in section 1.c of the Appendix. This list includes petitions seeking such declaratory rulings (e.g., those filed pursuant to 47 C.F.R. §§ 1.2, 1.5001) identified by each relevant Bureau or Office at the Commission as currently pending. Depending upon the nature of the particular matter, and based on the comments received on these petitions, these may be addressed by a Bureau or Office. The Commission cannot predict whether or when any of these petitions will be acted upon. Each of the first two lists includes the name of the item, the date of initiation of the item, and the legal authorities cited for the item pursuant to the Regulatory Flexibility Act and the Administrative Procedure Act.
