See Streamlined Process for Resolving Requests for Review of Decisions by the Universal Service Administrative Company, CC Docket Nos. 96-45 and 02-6, WC Docket Nos. 02-60, 06-122, 08-71, 10-90, 11-42, and 14-58, Public Notice, 29 FCC Rcd 11094 (WCB 2014). Sections 54.719(b), 54.1718(a)(1), and 54.2012(b)(2) of the Commission’s rules provide that any person aggrieved by an action taken by a division of USAC, after first seeking review at USAC, may seek review from the Commission. Sections 54.719(c), 54.1718(a)(3), and 54.2012(a)(3) of the Commission’s rules provide that parties seeking waivers of the Commission’s rules shall seek review directly from the Commission. In this Public Notice, we have reclassified as Requests for Waiver any appeals seeking review of a USAC decision that appropriately should have requested a waiver of the Commission’s rules. Similarly, we have reclassified as Requests for Review any appeals seeking a waiver of the Commission’s rules but that are, in fact, seeking review of a USAC decision. The deadline for filing petitions for reconsideration or applications for review concerning the disposition of any of these Requests is 30 days from the release date of this Public Notice. See 47 CFR §§ 1.106(f), 1.115(d); see also 47 CFR § 1.4(b)(2) (setting forth the method for computing the amount of time within which persons or entities must act in response to deadlines established by the Commission). In denying Bronx Preparatory Charter School’s waiver seeking a second invoice filing deadline extension, the Commission relied on the Ada School District Order as precedent. See Requests for Waiver of Decisions of the Universal Service Administrator by Ada School District et al.; Schools and Libraries Universal Service Support Mechanism, CC Docket No. 02-6, Order, 31 FCC Rcd 3834 (WCB 2016) (Ada School District Order). On reconsideration, Bronx Preparatory Charter School argues that the Ada School District Order is not relevant to its situation because that order applies to entities that failed to seek an extension before the invoice filing deadline. Bronx Preparatory Charter School, on the other hand, had timely applied for and received a one-time 120-day invoice deadline extension and was now seeking a second invoice filing extension. We find, however, that the Ada School District Order is applicable because it reiterates the Commission’s holding that second invoice filing deadline extensions are prohibited. See Ada School District Order, 31 FCC Rcd at 3935, para. 3 (noting that the “Commission prohibit[s] USAC from granting any other invoicing deadline extensions” other than the initial one-time 120-day invoice deadline extension, quoting Modernizing the E-rate Program for Schools and Libraries, WC Docket No. 13-184, Order and Further Notice of Proposed Rulemaking, 29 FCC Rcd 8870, 8966, para. 240 (2014) (E-rate Modernization Order)). As a result, Bronx Preparatory Charter School is barred from seeking a second extension invoice filing extension, no matter the circumstances. We therefore reaffirm our denial of Bronx Preparatory Charter School’s waiver and dismiss its petition. Bronx Preparatory Charter School, NY, Application No. 221034160, Petition for Reconsideration, CC Docket No. 02-6 (filed Mar. 4, 2026) Dismissing Petitions for Reconsideration – New Argument Raised on Reconsideration See, e.g., Allan Shivers Library Order, 29 FCC Rcd at 10357, para. 2 (dismissing petitions for reconsideration that fail to identify any material error, omission, or reason warranting reconsideration, and rely on arguments that have been fully considered and rejected by the Bureau within the same proceeding). In their second petitions for reconsideration, the petitioners now claim that the Bureau never intended for the 60-day appeal-filing requirement to apply to waiver requests of the FCC Form 471 application filing deadline, citing to the Acorn Public Library Order. See Requests for Waiver and Review of Decisions of the Universal Service Administrator by Acorn Public Library District et al., Schools and Libraries Universal Service Support Mechanism, CC Docket No. 02-6, Order, 23 FCC Rcd 15474 (2008) (Acorn Public Library Order). They argue that because this Bureau order, which granted waivers of the FCC Form 471 application filing deadline to certain E-Rate applicants, did not mention the appeal-filing requirements found in section 54.720 of the Commission’s rules, petitioners have unlimited time to file a waiver when the application filing deadline is missed. In support of this argument, they claim that two waiver requests granted in the order were late-filed yet still received waivers of the FCC Form 471 application filing deadline. Because the petitioners did not make this argument when they filed their waiver requests, nor did they raise it in their first petitions for reconsideration, we dismiss these petitions because they rely on an argument that was not raised previously. See 47 CFR § 1.106(b)(2), (c)(2) (stating that a petition for reconsideration will be entertained only if the petition relies on facts or arguments that have changed or were unknown to the petitioner when it previously filed at the Commission, unless it is required in the public interest). As an alternative and independent basis for rejecting these petitions, we also deny the petitions on the merits. While it is not clear from the record whether the two parties in the Acorn Public Library Order filed their waivers more than 60 days late, the order does not address this issue. The Acorn Public Library Order found that that special circumstances exist to justify granting a waiver of the FCC Form 471 application filing deadline where, for example, the form was filed within 14 days of the deadline, there was illness or death or there was circumstances beyond the applicant’s control. There is no mention of section 54.720 of the Commission’s rules in the order or how it applies to the timing of FCC Form 471 application filing deadline waivers. It should be noted that the Bureau consistently enforces the requirement of section 54.720 in all circumstances, including parties seeking waivers of the FCC Form 471 application filing deadline. For these reasons, we dismiss these petitions for reconsideration. We grant a waiver and direct USAC to issue the corrected FCDL consistent with the three-year contract amount. Consistent with the Commission’s decision to adopt the similar appeal and waiver rules that govern all of the Universal Service Fund programs, including the E-Rate program, and to leverage existing E-Rate processes and forms in the Cybersecurity Pilot Program, we rely on E-Rate program precedent to resolve these waiver requests of the Cybersecurity Pilot Program rules.
