The Commission has before it an Application for Review filed by Aerco Broadcasting Corp. (Aerco) concerning the decision of the Chief of Video Services Division denying Aerco’s petition for reconsideration of the Chief’s prior September 14, 1999 letter ruling. In that ruling, the Division Chief cancelled the license of WTRA( TV), Mayaguez, Puerto Rico, pursuant to Section 312( g) of the Communications Act of 1934, as amended, for the licensee’s failure to operate the station for twelve consecutive months. The above- referenced application of Carlos J. Lastra, Trustee of Bay Broadcasting Corp. (Trustee), for renewal of WTRA( TV) ’s license was also denied by the Division Chief, and an application to assign the license of WTRA( TV) from the Trustee to Aerco was dismissed. 2. We have reviewed the Division Chief’s decision and find that her ruling was correct. There is no reason to disturb it. See WAMC, Inc., 10 FCC Rcd 12219 (1995). 1 1 We also note that Aerco has not adequately demonstrated that it was a “person aggrieved” by the action taken pursuant to delegated authority thus entitling it to file an Application for Review under our Rules. See 47 C. F. R. § 1.115( a). 1 Federal Communications Commission FCC 01 -260 2 3. Accordingly, IT IS ORDERED, That the Application for Review filed by Aerco Broadcasting Corp. IS DENIED.
