 MEMORANDUM  OPINION  AND  ORDER 
 Adopted:  February  26,  2002  Released:  February  28,  2002 
 By  the  Commission: 
 1.  The  Commission  has  before  it  an  Application  for  Review  filed  by  Hispanic  Information  and  Telecommunications  Network,  Inc.  (HITN),  and  an  opposition  thereto  filed  by  Caribbean  University. 
 These  pleadings  related  to  the  April  27,  1999  letter  decision  by  the  Video  Services  Division,  Mass  Media  Bureau,  denying  HITN’s  petition  for  reconsideration  of  the  grant  of  Caribbean  University’s  application 
 for  a  new  Instructional  Television  Fixed  Service  (ITFS)  station  on  the  C  channel  group  at  Jardines  de  Ponce,  Puerto  Rico. 


 2.  We  have  reviewed  the  parties’  filings,  as  well  as  the  Division’s  denial  of  HITN’s  petition  for  reconsideration,  and  find  that  its  ruling  was  correct.  We  also  reaffirm  the  Division’s  conclusion  that 
 Caribbean  University’s  application  complied  with  all  applicable  ITFS  interference  protection  requirements  of  our  rules. 


 3.  Accordingly,  IT  IS  ORDERED,  That  the  Application  for  Review  filed  by  Hispanic  Information  and  Telecommunications  Network,  Inc.  IS  DENIED.
