To promote a more efficient, effective and responsive organizational structure, the Commission has concluded that the proper dispatch of its business and the public interest will be served by reorganizing the Wireless Telecommunications Bureau (Bureau). In this Order, we reorganize the Bureau to realign its structure to better support the Commission’s strategic goals and to consolidate similar functions to better focus resources. The reorganization we adopt reflects current and emerging changes in technology as well as addressing the intensely competitive landscape of the wireless industry. While improving the Bureau’s ability to fulfill its mission, the reorganization also provides several benefits for managing a large and diverse organization. The scope and size of the Bureau’s current divisions will be reduced to improve managerial oversight. Staff positions will be reallocated and redeployed to address critical issues as well as recruitment and staff career development needs. The reorganization will result in a flatter, more flexible organization, responsive to changes in wireless technology and the telecommunications business environment and emerging technologies. 2. Specifically, we create the following six divisions within the Bureau (in place of the five that currently exist): Auctions and Spectrum Access Division, Broadband Division, Mobility Division, Public Safety and Critical Infrastructure Division, Spectrum and Competition Policy Division, and Spectrum Management Resources and Technologies Division. In addition, as part of the reorganization, we create a Management and Resources Staff within the Bureau that combines the current Management and Planning Staff and the Auctions Expenditures Management Branch to centralize management controls over all aspects of both the auctions and appropriated budgets for which the Bureau is responsible. 1 Federal Communications Commission FCC 03- 291 2 3. Authority for the adoption of the foregoing reorganization is contained in Sections 4( i), 4( j), 5( b), 5( c), 201( b) and 303( r) of the Communications Act of 1934, as amended, 47 U. S. C. §154( i), 154( j), 155( b), 201( b) and 303 (r). 4. The amendments adopted herein pertain to agency organization, procedure and practice. Consequently, the notice and comment provisions of the Administrative Procedure Act contained in 5 U. S. C. §553( b) is inapplicable. 5. ACCORDINGLY, IT IS ORDERED that the Wireless Telecommunications Bureau is reorganized to the extent described herein. This action is TO BE EFFECTIVE upon adoption of this order.
