Powell and Commissioners Kathleen Q. Abernathy, Michael J. Copps, Kevin J. Martin, and Jonathan S. Adelstein. The FCC has determined that the public interest will be served if it delays enforcement of the recently adopted Red Light Rule from October 1, 2004 to November 1, 2004. The Red Light Rule, adopted as part of the FCC’s ongoing effort to implement the Debt Collection Improvement Act, provides that the Commission will check to determine whether entities or individuals seeking licenses or other benefits from the FCC are delinquent in debt owed to the Commission. Once the rule takes effect, anyone filing an application or seeking a benefit that is discovered to be delinquent in debt owed to the FCC will be notified of the delinquency and given 30 days to pay the debt in full or make other satisfactory arrangements. Failure to do so will result in dismissal of the application or other request for a benefit. The rule is scheduled to go into effect on October 1, 2004. The Managing Director has just provided a new Red Light Display (RLD) System, available at www. fcc. gov/ redlight, to enable entities doing business with the Commission to determine whether they have any delinquent debt. The public interest will be served by affording a brief period of time for interested parties to use the new RLD System prior to enforcement of the Red Light Rule. Accordingly, the Commission will not enforce the provisions of the Red Light Rule until November 1, 2004. Anyone doing business with the Commission is encouraged in the meantime to use the newly available system and to resolve any outstanding delinquencies prior to November 1.
