In this Forfeiture Order (“Order”), we issue a monetary forfeiture in the amount of ninety-seven thousand five hundred dollars ($97,500) against 1st Source Information Specialists, Inc. d/b/a LocateCell.com (“LocateCell”).1 LocateCell violated a Commission order by failing to respond to the directive of the Enforcement Bureau (“Bureau”) to provide certain information and documents.2 LocateCell acted in apparent and willful and repeated violation of Section 503(b) of the Communications Act of 1934, as amended, (“Act”)3 and Section 1.80 of the Commission’s rules (“Rules”).4 2. On July 13, 2006, the Commission issued to LocateCell a Notice of Apparent Liability for Forfeiture (“NAL”)5 proposing a forfeiture in the amount of ninety-seven thousand five hundred dollars ($97,500) based on LocateCell’s apparent violation of the Bureau’s directive. The NAL gave LocateCell the option of paying the proposed forfeiture or of filing a response to the NAL stating why the proposed forfeiture should either not be assessed or should be reduced. The NAL was sent by certified mail to LocateCell’s last known address.6 LocateCell has not filed a response to the NAL nor has LocateCell paid the proposed forfeiture amount. Based on the information before us, we affirm this forfeiture. 3. If the forfeiture is not paid within the period specified, the case may be referred to the Department of Justice for collection pursuant to Section 504(a) of the Act.9 4.
