                     RESCISSION OF TERMINATION ORDER

      By, Hearing Designation Order, Order to Show Cause, and Notice of Opportunity for Hearing in 
the above-captioned matter, the Chief, Media Bureau, pursuant to delegated authority, commenced a 
hearing proceeding to determine whether Roger Wahl is qualified to remain a Commission licensee and 
whether his license for Station WQZS(FM), Meyersdale, Pennsylvania, should be revoked.1  To avail 
himself of the opportunity to be heard and the right to present evidence at the hearing, Mr. Wahl was 
directed by the Order to Show Cause to file a written appearance stating that he would appear at the 
hearing and present evidence on the issues specified.2 
 
      No appearance was received by either the Presiding Judge or the Enforcement Bureau by the 
November 29, 2021, due date.  Nor was an appearance reflected in the Commission’s Electronic 
Comment Filing System (ECFS).  As a result, pursuant to Section 1.92 of the Commission’s rules, 47 
CFR § 1.92, the above-captioned hearing proceeding was terminated on December 1, 2021.3  It has been 
brought to the attention of the Presiding Judge, however, that Mr. Wahl did indeed submit an appearance 
via certified mail on November 11, 2021 and attempted to file an ECFS submission on that same date.  
The Termination Order will therefore be rescinded and this hearing proceeding restored to pending status.   
       
      Accordingly, IT IS ORDERED that the Termination Order in MB Docket No. 21-401 released 
December 1, 2021, by the Administrative Law Judge IS RESCINDED, as are all actions taken therein.
