On February 24, 2023, the FCC’s Media Bureau released a Hearing Designation Order in the above-captioned matter.1 As directed by that order, and pursuant to section 1.221(c) of the Commission’s rules, 47 CFR § 1.221(c), the following parties filed a timely Notice of Appearance: SGCI Holdings III LLC and Community News Media LLC TEGNA Inc. CMG Media Corporation and Teton Parent Corp. The News Guild-CWA and National Association of Broadcast Employees and Technicians-CWA United Church of Christ Media Justice Ministry Common Cause The Chief of the FCC’s Enforcement Bureau was made a party to the proceeding but was not required to file an appearance.2 2. Some of the Notices of Appearance do not include an email address for each person entering an appearance on behalf of a party. Nor is it clearly indicated in all Notices whether each person entering an appearance is an attorney. An initial status conference will be conducted on Wednesday, April 26, 2023, at 10:00 AM at FCC Headquarters, Room 1.400, 45 L Street, N.E., Washington, DC.4 On or before April 19, 2023, the parties shall submit a proposed schedule for this case, a description of the type of discovery anticipated, if any, and description of expected pre-hearing motions, if any. The proposed schedule shall, at a minimum, include the following dates and deadlines: Deadline for Completion of Discovery Deadline to Request Hearing on a Written Record5 Deadline to File Motion for Summary Decision Deadline for Exchange of Exhibits, Witness Lists, and Written Direct Testimony Deadline for Exchange of Witness Lists for Cross-Examination Deadlines for Objections to Exhibits and Written Testimony and replies thereto Pre-Hearing Motions Day6 Hearing Start Date Anticipated Length of Hearing Deadlines to file Proposed Findings of Fact and Conclusions of Law and replies thereto 4. Accordingly, IT IS ORDERED that the initial status conference in this matter will be held at FCC Headquarters on April 26, 2023, commencing at 10:00 a.m., at which a hearing schedule shall be established. All subsequent oral conferences, if needed, shall be conducted in this same manner unless otherwise directed. 5. IT IS FURTHER ORDERED that the parties shall submit the information required above on or before April 19, 2023. All written submissions in this proceeding shall be filed using the Commission’s Electronic Comment Filing System (ECFS) by 11:59 PM Eastern Time on the filing date. 6. IT IS FURTHER ORDERED that that parties shall serve filings on each other via electronic mail whenever possible.7 7. IT IS FURTHER ORDERED that all parties are put on notice that they are expected to be fully cognizant of Part 1 of the Commission's rules concerning Practice and Procedure, 47 CFR Part 1, Subparts A and B.
