                   FOR RESPONSE TO MOTION TO ENLARGE

      1.    On December 18, 2023, the FCC’s Enforcement Bureau moved to enlarge the issues in

the above-captioned hearing proceeding.1  Antonio Cesar Guel seeks additional time to respond to the 
Enforcement Bureau’s motion in light of the proximity of the due date to the Christmas and New Year’s 
Day holidays and ongoing work on other discovery responses in this proceeding.2  The Presiding Judge 
agrees that there is good cause to afford Mr. Guel more time to file a response.  She therefore extends the 
due date for Mr. Guel’s response to January 8, 2024, as requested.   
       
      2.    It must be noted, however, that Mr. Guel’s extension request misapplies the 
Commission’s rules as to timing.  Pursuant to section 1.294(b), 47 CFR § 1.294(b), oppositions to 
interlocutory requests in a hearing proceeding are due within four days of the original request unless 
otherwise specified.  In this case, then, Mr. Guel’s response to the Bureau’s December 18 motion was due 
on December 22.  Mr. Guel’s motion cites section 1.45 of the Commission’s rules, 47 CFR § 1.45, as 
support that the due date for his response was December 28.  Section 1.45, however, only applies 
“[e]xcept as otherwise provided in this chapter.”  As a result, the four-day period of section 1.294(b) 
controls.   
 
      3.    Accordingly, IT IS ORDERED that the Motion for Extension of Time filed by Antonio 
Cesar Guel on December 26, 2023, IS GRANTED to the extent indicated herein.  Antonio Cesar Guel’s 
response to the Enforcement Bureau’s Motion to Enlarge, filed on December 18, 2023, is due on or before 
JANUARY 8, 2024.  This action is taken pursuant to authority granted by sections 1.243(i) and (n), 
1.294(b), and 1.298(a) of the Commission’s rules, 47 CFR §§ 1.243(i) and (n), 1.294(b), and 1.298(a).
